Professional Ethics


2011(1) CURRENT TAMILNADU CASES – Page 602 – SUPREME COURT
Part VI, Chapter II, Section II, Clause 11 – Standards of Professional conduct and Etiquette – Bar Association passed resolution that no member of bar will defend Accused-Policemen in Criminal case – Duty of lawyer – Role of Advocates in society – Refusal to defend – Legality – Such resolutions are wholly illegal, against all traditions of bar, and against professional ethics – Every person has right to be defended in court of law and correspondingly it is duty of lawyer to defend him – Professional ethics requires that lawyer cannot refuse a brief, provided client is willing to pay his fee, and lawyer is not otherwise engaged – Any resolutions restraining bar members to defend persons is null and void.
